In brief

What does market entry mean for health and safety?
Different rules, different roles.

A foreign company that builds, installs or commissions in Germany must comply with German occupational health and safety law, including with posted workers. This covers risk assessment, instruction, coordination with other companies on site and your client's requirements. SAFETEE supports manufacturers, EPC contractors and project developers in the energy sector from the first conversation to handover.

Duties also apply to posted workers

The German Occupational Safety and Health Act applies to your employees in Germany, even when they are posted with an A1 certificate. Responsibility stays with you as the employer, but you can commission competent people.

Many parties, clear roles

Client, general contractor, grid operator, statutory accident insurance and authorities each have their own requirements. Whether you are the client, supplier or subcontractor determines which duties are yours.

Evidence before site start

Clients ask for risk assessment, HSE plan, proof of qualification and instruction records before the site opens. If something is missing, site access is delayed, often by weeks.

What is different in Germany

Occupational Safety and Health Act

Applies to all employees in Germany, and through § 2 of the Posted Workers Act also to posted workers. Its core is the risk assessment under § 5 ArbSchG.

A1 and accident insurance

With an A1 certificate, posted workers stay insured in their home country for up to 24 months. Without a valid A1, German social security law applies.

Notification before deployment

Foreign employers notify posted workers, for example for construction work, in advance to German customs via the minimum wage reporting portal.

Instruction that gets through

Instruction must be sufficient and appropriate (§ 12 ArbSchG). In practice this means: in a language your employees reliably understand.

Cooperation on site

Where several companies work together, they align their protective measures (§ 8 ArbSchG). Where they endanger each other, the principal appoints a coordinating person.

Construction Site Ordinance

The client appoints a coordinator (SiGeKo) once several employers work on site and, where required, files prior notice and a health and safety plan.

Electrical work under German rules

Work on electrical installations follows DGUV Regulation 3 and VDE standards. Your company confirms that your electricians know these rules.

Client requirements

Grid operators, clients and manufacturers have their own HSE standards, permit systems and reporting duties, often stricter than the law.

    Does German health and safety law apply to posted workers?

    Yes. Under § 2(1) no. 5 of the German Posted Workers Act, German rules on safety, health protection and hygiene at work also apply to employees of foreign employers working in Germany.     What foreign companies ask
    before their first project.

    Does German health and safety law also apply to our posted employees?

    Yes. Through § 2(1) no. 5 of the German Posted Workers Act, German rules on safety and health at work also apply to employees of foreign employers working in Germany. The duties under the Occupational Safety and Health Act lie with you as the employer. You can commission competent people to fulfil them, such as SAFETEE.

    Do we need an occupational safety specialist and a company doctor in Germany?

    That depends on your model. With your own German entity or employees hired in Germany, support under the Occupational Safety Act and DGUV Regulation 2 applies. For purely posted teams we clarify in the initial consultation what applies and how you meet your duties reliably.

    Who is responsible for coordination on site?

    The client appoints a coordinator under § 3 of the Construction Site Ordinance as soon as several employers work on site. As supplier or subcontractor you align your protective measures with the other companies under § 8 of the Occupational Safety and Health Act and follow the health and safety plan. If you are the client yourself, SAFETEE can take on the coordination.

    In which language must instruction take place?

    The Occupational Safety and Health Act requires sufficient and appropriate instruction. What matters is that your employees reliably understand it. In practice this often means instruction in their native language or in English, supported by pictures. SAFETEE offers training via the Academy in English as well.

    Does SAFETEE work with manufacturers or with project developers?

    With both. For manufacturers and EPC contractors we prepare organisation, documents and site and provide HSE managers on site. For project developers acting as client we also provide safety coordination under the Construction Site Ordinance. If we hold several roles in the same project, we staff them with different people.

    Can we work with SAFETEE in English?

    Yes. Initial consultation, gap analysis and reports are available in English, and the SAFETEE Academy also offers training in English. Official documents and parts of the site documentation are kept in German in Germany.

    How early should we start?

    At the latest when the contract and construction sequence are being negotiated. Client requirements, proof of qualification, risk assessment and HSE plan need lead time. Starting shortly before construction risks being refused site access.
